Please find below a selection of recent legislation changes relating to COVID-19 and communications for workplaces from key safety and environmental regulators in Australia and New Zealand.

LEGISLATION CHANGES

Defence Determination, Conditions of Service Amendment Determination 2021 (No. 6)

  • Makes changes to multiple Chapters of the Defence Determination 2016/19, Conditions of Service including, but not limited to, enabling members on a long-term posting overseas to travel domestically or to a third country to seek relief during COVID-19 restrictions without having their leave cancelled while travelling.

Migration (COVID-19 Pandemic Event for Subclass 408 (Temporary Activity) Visa and Visa Application Charge for Temporary Activity (Class CG) Visa) Amendment Instrument (No. 2) (LIN 21/038) 2021

  • Amends the Migration (LIN 20/229: COVID-19 Pandemic Event for Subclass 408 (Temporary Activity) Visa and Visa Application Charge for Temporary Activity (Class GG) Visa) Instrument 2020 to expand the class of persons specified in Section 8(3) to capture people who are employed by, or in receipt of an offer of employment from, an employer in the tourism and hospitality sector, and to allow for an application for a Subclass 408 visa to be made if the person holds a substantive temporary visa that is 90 days or less from ceasing.

Therapeutic Goods (Medical Devices - Information that Must Accompany Application for Inclusion) Amendment (COVID-19 Measures - Export Only and System or Procedure Packs) Determination 2021

  • Amends the Therapeutic Goods (Medical Devices - Information that Must Accompany Application for Inclusion) Determination 2018 to specify that a declaration of conformity made by a manufacturer must accompany an application for inclusion in relation to export only medical devices and in relation to a system or procedure pack that is classified as a Class 1 in vitro diagnostic medical device.


Public Health (Emergency) Declaration Further Extension 2021 (No 2)

  • Further extends the period during which the Public Health (Emergency) Declaration 2020 (No 1) is in force for 90 days.

Public Health (Residential Aged Care Facilities) Emergency Direction 2021 (No 3)

  • Provides for restricted access to residential aged care facilities in order to limit the spread of COVID-19 within a particularly vulnerable population.

Community Land Management Amendment (COVID-19) Regulation 2021

  • Provides for altered arrangements for convening, and voting at, meetings of an association or its executive committee, and allows instruments to be signed, and the signatures to be witnessed, rather than being affixed with the seal of an association in the presence of certain persons.

Public Health (COVID-19 Air Transportation and Maritime Quarantine) Amendment Order 2021

  • Amends the Public Health (COVID-19 Air Transportation Quarantine) Order 2021 and the Public Health (COVID-19 Maritime Quarantine) Order 2021 to require quarantined persons to undergo a COVID-19 test 2 days after leaving quarantine.

Public Health (COVID-19 Air Transportation Quarantine) Amendment (Cook Islands) Order 2021

  • Provides that a flight crew member or other person who arrives in New South Wales by aircraft from New Zealand is not required to enter quarantine just because another person on the aircraft has been in the Cook Islands within the previous 14 days.

Strata Schemes Management Amendment (COVID-19) Regulation 2021

  • Provides for altered arrangements for meetings of an owners corporation or a strata committee, and allows instruments and documents to be signed, and the signatures to be witnessed, rather than being affixed with the seal of an owners corporation in the presence of certain persons.

COVID-19 Testing and Vaccination Requirements (Contact by Health Workers with Cases) Direction (No. 2)

  • Requires COVID-19 routine surveillance testing, vaccination and mask wearing for health care workers in hospitals working with diagnosed cases of COVID-19.

Interstate Exposure Venues Direction (No. 2)

  • Requires individuals who enter Queensland, or who are already in Queensland, and have been to an interstate exposure venue during the exposure period to quarantine.

Emergency Management (Cross Border Travel - Associated Direction No 9) (COVID-19) Direction

  • Subjects all overseas arrivals (other than New Zealand arrivals) to Level 5 requirements, and arrivals from specified Victorian locations to Level 5 or Level 6 requirements.

Direction Under Section 16 - Contact Tracing - No. 5

  • Requires owners and operators of relevant locations to ensure that QR codes are used according to the direction and the required information is recorded and kept.

Direction Under Section 16 - Management of Premises - No.13

  • Sets the capacity of certain premises.

Extension of Emergency Declaration

  • Extends the public health emergency for 12 weeks.

Notice Under Section 20 of the COVID-19 Disease Emergency (Miscellaneous Provisions) Act 2020

  • Provides for changes to sittings of the Tasmanian Supreme Court and the Supreme Court criminal jurisdiction.


Workplace Directions (No 28)

  • Limits the number of Victorians attending work premises to assist in reducing the frequency and scale of COVID-19 outbreaks in Victorian workplaces and establishes more specific obligations on employers and workers in relation to managing the risk associated with COVID-19 - came into force at 9.00 am 18 May 2021.

Extension of State of Emergency Declaration

  • Extends the state of emergency declaration made on 15 March 2020 for 14 days.

Special Direction - Waiver of Certain Requirements for the Making of a Transit Visa Application from Tonga and Samoa During Covid-19 Travel Restrictions

  • Waives some application requirements under Regulation 15(1)(c) and (d) of the Immigration (Visa, Entry Permission, and Related Matters) Regulations 2010 for transit visa applications for persons in Tonga and Samoa to simplify the transit visa application process which is currently impracticable.
